1. These Terms

1.1 What these terms cover.
These are the terms and conditions on which we supply our products to you on Moore Maxxam’s Ecommerce shop on https://www.mooremaxxam.com/ (in the following referred to as the “Ecommerce shop”).

1.2 Why you should read them.

Please read these terms carefully before you submit your order to us.  These terms tell you who we are, how we will provide products to you, how you and we may change or end your order, what to do if there is a problem and other important information. These terms and conditions apply to all purchase orders submitted to us and may be updated and vary from time to time. If you do not agree to these terms, you must not order any products from our Ecommerce shop. We encourage you to read these terms and conditions prior to every order you place in the Ecommerce shop.

3. Our contract with you

3.1 How we will accept your order.

Our acceptance of your order will take place when we email you to accept it (Order Confirmation). Payment is required by credit or debit card, before goods are dispatched. 

3.2 If we cannot accept your order.
If we are unable to accept your order, we will inform you of this by email and will not charge you for the product. This might be because the particular colour/size of your order is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because a payment provided by you is not authorised or validated by a card issuer or a bank, or because we have identified an error in the price or description of the product. If we have debited your account, we will refund you as soon as possible, but in any event within 5-7 working days of your order. We are not obliged to offer any additional compensation if we cannot accept your order.

3.3 Your order numbers.

We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order. It is important you include your order number in any correspondence to us relating to an order.

 

4. Our products

4.1 Conformity.
We guarantee that our products comply with these Terms. We warrant that, upon delivery, the products will be of satisfactory quality and conform to their description.

4.2 Products may vary slightly from their pictures.
The images and description of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours and fabric accurately, we cannot guarantee that a device's display of the colours or fabrics accurately reflects the colour and fabric of the products. Your product may vary slightly from those images. 

4.3 Product packaging may vary.
The packaging of the product may vary from time to time.

4.4 Size charts for guidance only.
Please read the size chart on our Ecommerce shop which gives you guidance instructions on how to check your child’s measurements. However, if you are not sure please email us and we will be happy to help to prevent returns.‍

 

5. Price and Payment

5.1 Price.

Any prices stated on our Ecommerce shop exclude any import duties. We have the right to modify our prices from time to time. We are not bound by price indications on our Ecommerce shop which consumers must reasonably understand. Reasons for why they could be shown incorrectly, for example, occurred due to technical problems in the web platform or that have been manipulated by third parties.

5.2 VAT and import duties.

Prices are inclusive of UK VAT at zero rate for all products we supply, and are payable in the currency indicated on our Ecommerce store. For EU and non-EU customers, additional customs charges and other postal costs may be incurred by your local Customs Authority on your import at applicable rates.

5.3 Payment.

We use Shopify's Payment Service to collect payment from you. All payment details are held securely with your payment provider, we do not have any direct access to your payment details. By submitting an order through Shopify Payment Service, you confirm that the payment details are valid and correct, and when your order is accepted and proceeds with us, payment will be made in full.

6. Your rights to make changes

If you wish to make a change to the product you have ordered please contact us as soon as possible. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of delivery or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

7. Our rights to make changes

7.1 Changes to the products.

We may make the changes to the products which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes on our Ecommerce store.

7.2 Changes to these terms.

We may update these terms and conditions from time to time and we will notify you of these changes on our Ecommerce store.

8. Delivery

8.1 Delivery costs.

The costs of delivery will be specified in the order summary before you submit your order. Please be advised that custom duty costs may be charged for any orders from outside the UK.

8.2 When we will provide the products.

We always aim at delivering your order as soon as possible. Normally orders of items in stock ship within [1-2] business days from order confirmation and can be expected to be delivered within [1-15] business days. Delivery times are estimates only and particularly during holiday and sales season deliveries may take longer than normal i.e. Christmas and Bank Holidays.

8.3 We are not responsible for delays outside our control.

If our supply of products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.

8.4 If you are not at home when the product is delivered.

If no one is available at your address to take delivery and the products cannot be posted through your letterbox, our courier partner will leave you a note informing you of how to rearrange delivery or collect the products from a local delivery depot. This may not apply to all countries.

8.5 If you do not re-arrange delivery.

If, after a failed delivery to you, you do not re-arrange delivery or collect your order from a delivery depot, we reserve the right to debit you a charge to cover our cost for return freight and administration.

8.6 When you become responsible for the goods.

The goods will be your responsibility from the time we deliver the product to the address you gave us. You are asked to inspect delivered items upon delivery and report any deviations found to us as soon as possible. 

8.7 When you own goods.

You own your goods once we have received payment in full.

8.8. Reasons we may suspend the supply of products to you.

Although we will make best endeavour to supply our products to you, we may have to suspend the supply of a product to:

a) issues with technical problems or minor technical changes;

b) changes in relevant laws and regulatory requirements;

c) made changes to the product as requested by you, the customer or notified by us to you (see clause 6).

9. Right of withdrawal and Returns

9.1 Right of withdrawal.

You, as a consumer, have a legal right to change your mind within 14 days and receive a refund. The term commences at the time at which you have received the entire order from us. We will inform you of this right of withdrawal either by email prior to delivery, or in writing on delivery of the products ordered.

9.2 How to invoke your right of withdrawal.

In case you wish to invoke your right of withdrawal, you must notify us by email at returns@mooremaxxam.com within 14 days from the date of receipt. Otherwise, please send your goods back to our address (see clause 9.4), within 14 days without first notifying us. In both cases, you are required to enclose in the return shipment, a copy of your original invoice.

9.3 Returning products after invoking your right of withdrawal.

If you have invoked your right of withdrawal for any reason after your products have been dispatched to you or when received, you must return them to us within 14 days. Goods should be sent back to us in the same condition as received, if possible in their original packaging. The products returned should not be damaged or modified, and should be under unused condition with all tags still attached. The cost of return shall be borne by you the consumer.

9.5 When and how you’ll pay the costs of return.

As soon as we have received the returned products, and have been able to confirm that the requirements above are met, we will refund your payment. If the returned products do not meet the requirements, we might not refund you the whole purchase amount. We will send you an email regarding the returned products and your refund once the return has been processed by us, money will take up to 10 working days to show on your account due to varying processing times between payment providers.

10. If there is a problem with the product

10.1 How to tell us about problems.

10.2 Damaged Products.

We ensure that all our products are meticulously checked through quality control before being dispatched to you. We work hard to avoid any damages or defects to our products. However, if you find that an item is damaged or faulty, we’ll offer you a replacement of the original purchased product dispatched at no extra costs once we’ve received and checked the faulty item OR a refund with the original cost of the product. You are asked to always examine your received products at the time of delivery and report any deviations from your order confirmation to us as soon as possible. The cost of return shall be borne by you the consumer. Please email us at returns@mooremaxxam.com to resolve your issue, we’ll then ask you to fill out our “Returns Form” to confirm the arrangement. The return of faulty goods must include a copy of the original invoice.

11. Exchange Policy

We are currently not able to process exchanges. If you'd like to swap your item, please return your item as a refund and purchase your desired item as a new order. We're very sorry for the inconvenience. The cost of return shall be borne by you the consumer.

12. How we may use your personal information

12.1 How we will use your personal information.

We will only use your personal information as set out in our Privacy Policy.

13. Our Intellectual Property Rights

13.1

All materials on this Ecommerce store, and the Ecommerce store itself, are protected by copyrights, designs, trademarks and/or all other intellectual property rights and materials are owned by Moore Maxxam Ltd. Such materials include, but are not limited to, the photographs, images, illustrations, text, video clips, audio clips, designs, logos, trademarks, and other materials contained in this site, as well as the software used in the design and development of this site. All rights are reserved, worldwide.

Reproducing, copying, editing, transmitting, uploading or incorporating into any other materials, any of the Ecommerce store including without limitation, any images in any format of the products and their descriptions and other material made available on the website; and removing, modifying, altering or using any registered or unregistered marks/logos/design owned by Moore Maxxam Ltd, and doing anything which may be seen to take unfair advantage of the reputation and goodwill of Moore Maxxam Ltd or could be considered an infringement of any of the rights in the intellectual property rights owned by and/or licensed to Moore Maxxam Ltd.

14. Other important terms

14.1 We may transfer this agreement to someone else.

We may transfer our rights and obligations under these terms to another organisation.

14.2 You can always transfer our guarantee as a consumer.

You may transfer our guarantee at clause 4.1 to a person who has acquired the product from you. We may require the person to whom the guarantee is transferred to provide reasonable evidence that they are now the owner of the relevant product.

14.3 Jurisdiction.

These terms and all matters connected with any order you place in our Ecommerce shop are governed by English law.
